| Abstract: | この論文は，判決の判断基準と理由づけについて検討する。前者については，これまでは判断過程が問題とされ，リアリズム法学，利益考量論が主張されてきたが，主に基準として機能するものは判例であることを主張する。理由づけについては，利益考量によるのではなく，より説得力のある理由づけをすべきであると主張し，その方法を検討する。 |
